All access to and use of our Website (including this site) and our call centre is subject to these terms and conditions (“Terms of Use”). By accessing, registering and using this Website, you agree to comply with, and be bound by, these terms and conditions. If you do not agree to any terms and conditions of this Agreement, you are not permitted to access and use this Website and you should cease accessing and using this Website immediately. Please read this Agreement carefully before using the Website.

2. Third Party Partners and Products

2.1 You should note that this Website (including any partners, services, products, offers and price references and product descriptions and features) is frequently updated. Partners, services, products and offers may be withdrawn at any time, and without notice.
2.2 This website provides an information service to obtain quotes and compare a selection of a variety of products and services on the basis of particular criteria that you may select including participating partner or retailer brand, service offering and price. The products and services compared and quoted may not be representative of all available products and services in the market for your selected service type. Not all participating partners, retailers and brands may be available at all times.
2.3 This website provides you with factual information, outline of services and offers, advertisements for other retailers and links to their websites. It may also contain general recommendations about products, services and offers and what you should consider when buying. It does not contain any personal recommendations, suggestions, advice about the suitability of a service, offer or product for your needs, and does not take into account any consideration of your individual circumstances. 3. Changes to Offers

3.1 All Offers available from Easy Switch are accessible via the Website, call centre and the Mobile App. The Offers are subject to availability and to the Offer Terms. If there is any inconsistency between the Offer Terms on the Easy Switch website and the offer terms on the Participating Partner’s website then the Participating Partner’s website shall prevail.
3.2 Much of the information on the Website, in the Mobile App and our call centre is provided by Participating Partners. Whilst we believe that Participating Partners are reliable sources of this information, we will not be responsible for the accuracy or currency of such information.
3.3 Participating Partners may change, modify, withdraw or cancel their respective Offers from Easy Switch at any time. We will provide you with as much notice as possible via the Website and Mobile App of any change but we will not be liable to any person for failure to provide such notice.
3.4 Our participating partners provide services with discounts, you cannot alter in any way the discount or special offer provided, and the discount is not a substitute for, nor exchangeable or redeemable for, cash.

4. Permitted Use and Links

4.1 You may not use the Website or Mobile App for any purpose that is unlawful or prohibited by these Terms and Conditions, or to solicit the performance of any illegal activity or other activity, which infringes the rights of us or other users.
4.2 You agree that if you provide any information on this Website or to our call centre, that the information will be true, accurate and complete.
4.3 You are only permitted to use this Website for personal use, subject to your compliance with these Terms of Use. Commercial use of this Website is strictly prohibited.
4.4 You are not permitted to do anything that may affect the security of this Website or any information or material stored within it.
4.5 You are solely responsible for the activity that occurs on your account and you must keep your account password secure. We are not responsible for any unauthorised activity on your account if you fail to keep your account login information secure.
4.6 Any password you create or are allocated to enable you to use the website, our call centre or services, must be kept confidential. You must immediately notify us if any unauthorised third party becomes aware of that password.

Links to individual graphics or to areas that are considered “security areas” that bypass any security protection or password protect that Easy Switch establishes are expressly prohibited. 4.11 You must only use this website, and you must only display, copy, distribute download and print portions of this website for your own personal use. You must not attempt to change, reproduce, add to, remove, hack or interfere with this website or its material.

5. Pricing

5.1 All amounts are stated in Australian dollars. All published prices include Australian GST (where applicable).
5.2 You must arrange for payment for any offer in accordance with the requirements of the relevant Participating Partner and agreed with that Participating Partner.

6. Offers

6.1 Easy Switch publishes offers available to Customers via the Website or Mobile App. You may access an offer via the Website or Mobile App and may be diverted to a website operated by the Participating Partner or contacted by our call centre staff.
6.2 You enter the Offer arrangements with Participating Partners at your own risk. We will not be liable for the unavailability of any offer or for any delay, failure, misrepresentation or negligence by a Participating Partner associated with an offer. For the avoidance of doubt, we do not make any warranties regarding any offers promoted or otherwise entered into by you through the Easy Switch website or mobile app.
6.3 Any dispute concerning an offer will be settled between you and the relevant Participating Partner. We take no responsibility for resolving such disputes or for the dispute itself.

7. Liability

7.1 Easy Switch is a platform that only allows you to access discount or special offers from a participating partner. The participating partners are responsible for, goods or services provided in accordance with the terms of the discount or special offer.
7.2 We do not warrant the accuracy or completeness of any information you derive from this website and we exclude liability for loss or damage arising from any errors or omissions in this website or your use of this website (including any interference with or damage to your computer system). If any liability is not able to be excluded by law, we limit our liability to the resupply of the relevant information or services.
7.3 You release Easy Switch, its servants and agents to the fullest extent permitted by law from any and all claims arising out of or related to the use of material or information made available through this website.
7.4 We will not be held liable for any loss of use, profits or data or any indirect, special or consequential damages or losses, whether such losses or damages arise in contract, negligence or tort, or otherwise in relation to any of the following:

• (a) your use of, reliance upon or inability to use this Website, the website content and/or our call centre;
• (b) the deletion with or without notice or cause of any of your data and/or information stored on this Website;
• (c) any loss of your content and/or communications resulting from delays, non-deliveries, missed deliveries, service interruptions or a failure, suspension or withdrawal of all or part of this Website at any time;
• (d) the removal from this Website of any content and/or communications sent or posted by you on or via this Website;
• (e) any circumstance that is outside of our reasonable control; and
• (f) any loss or damage that is not directly caused by us or which we could not reasonably expect at the time we entered into our agreement with you.

7.5 We aim to provide an uninterrupted access to this Website but we give no warranty as to the uninterrupted availability of this Website; and we also reserve the right to suspend, restrict and/or terminate your access to this Website, our Mobile app and/or our call centre, at any time.
7.5 To the fullest extent permitted by law, our liability in relation to the supply of goods or services not of a kind ordinarily acquired for personal, domestic or household use or consumption for breach of a consumer guarantee under the Australian Consumer Law is waived.

8. Force Majeure

8.1 We shall not be liable for any breach of its obligations under this Agreement where it is delayed, hindered or prevented from carrying out its obligations by any cause outside its reasonable control including without limitation by lightning, fire, flood, extremely severe weather, strike, lock-out, labour dispute, power surge, black out, brown out, act of God, war, riot, civil commotion, malicious damage, failure of any telecommunications or computer system, compliance with any Law, a restraint of a government agency, accident (or by any damage caused by any of such events).

9. Do Not Call Register – Consent

9.1 For the purposes of the Do Not Call Register Act 2006 (if it applies) – by submitting your details including your telephone number to Easy Switch, you give your consent to us to contact you by telephone on that number. Your consent will be either an express or deemed consent

10. Governing Law and Jurisdiction

10.1 If any part of these Terms and Conditions is found to be void, unlawful or unenforceable then that part will be deemed to be severable from the balance of these Terms and Conditions and the severed part will have not affected the validity and enforceability of any remaining provisions.
10.2 This Agreement shall be governed by and construed in accordance with the laws of the State of Victoria and both parties irrevocably submit to the exclusive jurisdiction of the courts of the State of Victoria, Australia.
